This Privacy Policy explains how we handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (Privacy Act).
In this Privacy Policy, ‘you’ or ‘your’ refers (as applicable) to:
the brands (and their teams) who subscribe to or use the Platform (Merchants);
consumers who interact with our Merchants or who use the Platform to directly manage their own data (Individual Users);
anyone else who interacts with Myne or the Platform, including contractors, suppliers, job applicants and website visitors.
This Privacy Policy applies to personal information we collect in connection with the Platform. It does not apply to employee records that are directly related to a current or former employment relationship with us, which are exempt under the Privacy Act. Information collected from contractors and suppliers is handled in accordance with this Privacy Policy unless otherwise exempt.

Our Roles (Data Processor v Data Collector)
Depending on how we handle your data, we play two key roles:

What it involves for your personal information
Data Processor
We act as a ‘data processor’ for our Merchants. This means we process personal information submitted by Merchants about their customers / end users as instructed by the Merchants. In this case, we are not the ones collecting the personal information from the end users/customers.
Data Processor
We act as a ‘data controller’ in two situations where we are the ones directly collecting your personal information:
Direct interaction: When you provide information directly to us (eg. registering for a Myne account, visiting our website, or contacting support).
User-authorised access: When you, as an Individual User, authorise Myne to act on your behalf to access, aggregate or manage your personal information from third-party brands or Merchants. In this situation, you grant Myne the right to retrieve your data from these third parties or Merchants to provide our services to you.
What information do we collect?
The information we collect depends on your relationship with us and the role we are performing.

Account Details: Name, email, job title, and login credentials.
Commercial Information: Business registration details (ABN), billing information, and platform usage logs.
Integration Credentials: API keys or tokens required to connect your third-party tools (e.g., POS, Shopify, loyalty platforms etc) to the Platform.
Testimonials: Feedback or reviews you provide (subject to your consent).
Information about Individual Users (Processor Role)
Identity Data: Name, email address, phone number, and birthdate
Transaction Data: Order history, spend tiers, itemised receipts, and visit frequency.
Tokenised Payment Data: To link transactions across visits, we may collect secure, tokenised payment card data (we do not store full credit card numbers).
Communication Data: The content of SMS and emails sent between a Customer and a Merchant via the Myne unified inbox.
AI Signals: Data our AI generates based on transaction history, such as purchasing preferences.
Information about Individual Users (Controller Role)
Profile Data: Information you provide to set up a customer profile or Myne account.
Authorised third party data: Data we collect from third parties or Merchants at your specific request.

Under 16 years old: We do not knowingly collect personal information from any person under 16 years of age. If you believe we have inadvertently collected such information, please contact us so we can delete it.

Customer support: Notify you of any change to our services, solve issues via live chat support, phone or email including any bug fixing.
Marketing:
Merchants: We may send you updates about our services. You can opt out via the link in our emails.
Individual Users: We do not send marketing to you on our behalf - if you receive any marketing from a Merchant via the Platform, you may unsubscribe via the link provided in the Merchant’s message.
Sharing your information
We do not sell personal information to data brokers. We share data only as necessary:
Merchant: Customer profiles are visible to the specific Merchant you visited.
Service Providers: We use trusted third parties to help us run the Platform (eg. AWS for hosting, AI providers for analysis, telecom providers for messaging).
Legal & Corporate: We may disclose information if required by law, to protect our rights, or in connection with a business transaction (such as merger, acquisition or sale of assets). In such cases, user information is typically one of the transferred business assets.
Links to other websites
Our Platform may contain links to other websites or applications that are not operated by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites or services. We strongly advise you to review the privacy policy of every site you visit.

If you have given Myne your data
If you are a direct user of the Platform (eg. Merchant or an Individual User with a Myne account), you can request access to, correction of, or deletion of your personal data directly from us. Please contact the Privacy Officer
If a Merchant has given Myne your data
If your data is held by Myne on behalf of a Merchant, you should generally contact that Merchant directly. If you contact us, we will refer your request to the Merchant.
International rights (EEA/GDPR)
If you are located in the European Economic Area (EEA), you have specific rights under the GDPR, including the right to erasure, portability, and restriction of processing. Please contact us to exercise these rights.
